General provisions

§ 1

Whenever these Terms & Conditions refer to:

  1. Regulations – shall mean this document,
  2. Company – shall be understood as BARBARA LUIJCKX Sp. z o.o., with its seat in Latkowo 40, 88-100 Inowrocław (Kujawsko-Pomorskie province, Poland), registered under KRS number 0000093864, NIP 5562253772, REGON 09236998900000,
  3. Service, Website – shall be understood as the website located on the public Internet network at http://www.barbara-luijckx.pl and http://www.barbara-luijckx.com,
  4. User – shall mean any natural person using the Service,
  5. Newsletter, Commercial Information – shall mean commercial information referred to in Art. 2 para. 2 of the Act of 18 July 2002 on the provision of electronic services (Polish Journal of Laws of 2013, item 1422, consolidated text),
  6. End Device – shall mean any telecommunications end device referred to in Art. 2 para. 43 of the Act of 16 July 2004 – Telecommunications Law (Polish Journal of Laws of 2014, item 243, consolidated text),
  7. Cookies – shall mean computer data, in particular text files, stored in Users' End Devices and intended for facilitating use of the Website.

§ 2

  1. These Regulations lay down general rules and conditions of:
  2. use of the Website,
  3. protection and processing of Users' personal data,
  4. use of the Cookies by the Website,
  5. ordering by the User and sending by the Company Commercial Information in electronic form.

§ 3

This Service shall be governed by the applicable laws on the territory of the Republic of Poland.

Terms of Website Use

§ 4

  1. The Website aims to promote the Company and advertise products offered by the Company, as well as provide basic information about the Company.
  2. Any catalogues, news, advertisements, price lists and other information and marketing materials contained on the Website do not constitute an offer within the meaning of Art. 66 et seq of the Civil Code.
  3. Any contact forms contained on the Website are only intended to make contact with the Company, and their filling and sending do not constitute an offer within the meaning of Art. 66 et seq of the Civil Code.
  4. Company's reply to inquiry sent through the forms referred to in the paragraph above is for informational purposes only and shall not be construed as a reply to an offer, nor expresses a will to be bound by any offer, unless explicitly stated otherwise in the reply.
  5. The Company does not provide any services directly through the Website. In order to place an offer or conclude a contract, it is necessary to contact the Company directly.
  6. Terms and conditions of sales of products and services by the Company are defined in separate regulations and agreements with the customers.
  7. Marketing materials available after logging on to the application located at http://www.barbara-luijckx.pl/do-pobrania/strefa-partnera.html may be used only on terms specified in the agreement concluded between the Company and its partner.
  8. All marketing materials contained on the Website are the exclusive property of the Company.

The collection, protection and processing of personal data through the Service

§ 5

  1. The Company's policy of processing and protection of personal data is in accordance with the provisions of the Act of 29 August 1997 on Personal Data Protection (Polish Journal of Laws of 2014, item 1182, consolidated text), hereinafter referred to as the Act on Personal Data Protection.
  2. The Company ensures exercise of all rights under the Act on Personal Data Protection of persons whose personal data are collected and processed through the Website.
  3. Before giving each consent to the processing of personal data through the Website, the User is obliged to familiarize himself/herself with the contents of these Regulations.

§ 6

  1. The entity indicated in § 1 para. 2 of these Regulations is the Personal Data Administrator under Art. 7 para. 4 of the Act on the Personal Data Protection.
  2. Personal data is collected through the Website in order to improve the quality of service and allow contact with the interested User, as well as to send Commercial Information ordered by the User, and is processed exclusively for the purposes of the Company.
  3. A person whose data is processed in the database of the Company has the right to access his/her data and correct it, as well as control the processing of data concerning this person contained in the database, in accordance with the provisions of the Act on Personal Data Protection.
  4. A person who requests information shall receive an answer in writing not later than 30 days from the date of receipt of the request. At the request of the data subject, the information referred to in the sentence above shall be given in writing.
  5. The person concerned can exercise the right to information referred to in Art. 32 para. 1 point 1-5 of the Act on Personal Data Protection not more frequently than once every 6 months.
  6. The Personal Data Administrator may refuse to provide information referred to in Art. 32 para. 1 point 1-5a of the Act on the Personal Data Protection to the data subject, if doing so would in particular:
    1. 1) disclose information containing classified information,
    2. 2) constitute a substantial infringement of personal interests of the data subject or other persons.
  7. Should the data subject demonstrate that the personal data relating to him/her are incomplete, outdated, untrue or collected in violation of the Act, or in case they are no longer required to achieve the purpose for which they were collected, the Personal Data Administrator shall be obliged, without undue delay, to amend, update, or correct the data, or to temporarily or permanently suspend the processing of the questioned data, or to have them erased from the database.
  8. Provision of personal data by the User is voluntary and shall be always preceded by his/her consent, referred to in Art. 23 para. 1 point 1 of the Law on Personal Data Protection, by means of a declaration (an appropriate checkbox) in the contact form.
  9. By agreeing to the processing of personal data, the User declares that he/she has attained the legal age of majority, or that his/her legal guardian has given such consent.
  10. The Company is not liable for submitting inaccurate statements referred to in paragraph 9.

Cookies Policy

§ 7

  1. The Service stores and accesses information (cookies) already stored on the User's End Device to improve the quality of Service.
  2. The User can specify the conditions for storing or accessing information referred to in paragraph 1 through the web browser (software installed in the User's End Device) (information on changing browser settings and on cookies is available at: http: //wszystkoociasteczkach.pl/, as well as http://jakwylaczyccookie.pl/; English version at: http://www.allaboutcookies.org/manage-cookies/).
  3. Disabling cookies or limiting access to cookies stored on the User's End Device may cause improper operation of certain functions of the Website.
  4. The company is not liable for any irregularities referred to in paragraph 3.
  5. Cookies and their use do not cause any configuration changes in User's End Device or software installed on the End Device.
  6. The User consents or refuses to give his/her consent to the use of cookies for the purpose and in the manner specified in paragraph 1 through the appropriate settings of his/her browser (software installed in the User's End Device).
  7. The User is obliged to familiarize himself/herself with the provisions of these Regulations relating to cookies before using the Website.
  8. The company is not liable for any malfunction of the browser resulting in the use of cookies contrary to the actual will of the User.

Commercial Information

§ 8

  1. The Company sends, on the request of the User, the Newsletter through the Service.
  2. The User agrees to receive Commercial Information by checking the appropriate box, typing his/her e-mail address, and clicking the "SUBSCRIBE!" button in the contact form on the Website, at http://blog.barbara-luijckx.com/.
  3. The consent referred to in para. 2 is equivalent to ordering Commercial Information within the meaning of Art. 10 para. 2 of the Act referred to in § 1 para. 5 of these Regulations.

Final Provisions

§ 9

  1. The Website and all materials contained therein are subject to copyright law under Art. 1 of the Act of 4 February 1994 on Copyright and Related Rights (Polish Journal of Laws of 2006, No. 90, item 631, consolidated text) and shall be protected under the provisions of this Act.
  2. It is forbidden to use the Service for purposes incompatible with these Regulations or with generally applicable laws.
